Terms of service

These terms are the agreement between you and Federico De Visdomini, an individual based in Milan, Italy (20123 Milano), who runs Elio until its company is formed ("Elio", "we", "us"). When the company is formed, these terms pass to it; we will tell you before that happens. Contact: support@eliostudy.com.

Please read them. The parts about prices, renewal, cancellation and refunds are in sections 6 and 7.

1. What Elio is

Elio is a study service for students taking the International Baccalaureate Diploma Programme. It plans your study, teaches and tests you with original questions and lessons, and estimates where your grades stand.

Elio is independent. Elio has been developed independently from and is not endorsed by the International Baccalaureate Organization. International Baccalaureate® and IB® are registered trademarks of the International Baccalaureate Organization.

Estimates are estimates. Elio's grade estimates are calculated from your answers and shown with a range. They are not your IB predicted grades, not a forecast your school or the IB uses, and not a promise of any result. How you do depends on many things Elio does not control.

The iOS app. Downloading and using the Elio app from the App Store is governed by Apple's standard Licensed Application End User Licence Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which is between you and Apple. These terms govern the Elio service itself, whichever way you reach it. Where the two differ about the service, these terms apply. Apple is not a party to these terms and has no obligation to support the service.

2. Who can use Elio

• You must be 13 or over. Elio is not for children under 13. If we learn that an account belongs to someone under 13, we refuse it and delete it along with everything in it.
• If you are under 16, a parent or guardian must consent before a plan can start. We ask for their email address and they confirm by following a link we send them. Until they do, the account waits.
• [LAWYER: under Italian law, a minor (under 18) has limited capacity to enter a contract, and a contract made by a minor is voidable (Civil Code, art. 1425 and 1426). Decide whether a paid plan for a minor of any age must be taken out, or confirmed, by a parent or guardian, and word this section, the checkout and the App Store purchase flow accordingly. Note that on iOS the purchase is made in the Apple Account, where Apple's own Family Sharing and Ask to Buy controls may already sit between a minor and a purchase; that does not by itself answer the capacity question.]
• The information you give us must be accurate, and an account is for one person.

3. Starting without an account

You can start setting Elio up before creating an account. What you enter is kept for [N] days; if you do not create an account in that time, it is deleted. Creating an account at the end of setup keeps everything you have done.

4. Your account

You accept these terms when you create your account, by ticking the box that says so (or turning on the switch in the app). We keep a record of which version you accepted and when. If we change these terms (section 15), we ask you to accept the new version before you carry on using your account.

Keep your password to yourself and tell us at support@eliostudy.com if you think someone else has used your account. You are responsible for what happens in your account unless it happened because of our failure.

5. Plans

Elio has two plans.

• Graphite: the study system.
• Brass: the study system, with Elio beside you (hints and quick lessons when you are stuck, and conversations with Elio about your week and progress).

What each plan includes at the time you buy is shown before you pay, and it is part of your contract.

6. Prices, payment and renewal

Where you buy decides who bills you. A subscription bought inside the Elio app on an Apple device is bought from Apple and billed to your Apple Account. A subscription bought on the web, when we offer one, is bought from us and billed by our web payment provider. Both give the same plan and the same service; what differs is who takes the money, and therefore who cancels and who refunds.

Prices are shown before you pay, in euros, including VAT. On iOS the price shown by the App Store is the price you pay. [LAWYER / OWNER: confirm the €15, €12, €25 and €20 prices include VAT, and that the App Store price tier chosen matches them after Apple's own rounding.]

6.1 In the Elio app (Apple)

Elio is a subscription. Graphite is 15 euro per month or 144 euro per year; Brass is 25 euro per month or 240 euro per year. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours of the end of that period. You can manage your subscription and turn off auto-renewal in your Apple Account settings after purchase. Any unused part of a free trial is forfeited when a subscription is bought.

Access codes. A code redeemed in the app is an Apple Offer Code, redeemed through Apple's own sheet, and it applies to the subscription in your Apple Account. The app has no code field of its own. Whatever a code gives is stated where the code is given.

6.2 On the web

• You can pay monthly or yearly. Payment is taken in advance for each period through our web payment provider. [LAWYER / OWNER: name the provider here once the web checkout opens; as built, nothing on the web takes a payment.]
• Your plan renews automatically at the end of each period, at the price then in force, until you cancel. For yearly plans, we email you at least [30] days before the renewal date.
• Price changes apply only from your next renewal, and we tell you at least [30] days before. If you do not accept the new price, you can cancel before it applies.

7. Cancelling and refunds

7.1 Bought in the app (Apple)

• Cancel in your Apple Account subscription settings, on the device or at the App Store. Cancelling stops the renewal; your plan stays active until the end of the period you have paid for. We cannot cancel an Apple subscription for you, and deleting the Elio app does not cancel it.
• Refunds are requested from Apple, who is the seller, through reportaproblem.apple.com or your Apple Account purchase history. Apple decides them under its own terms. We do not hold the payment and cannot refund it.
• Your legal right of withdrawal for the purchase itself is exercised against Apple in the same way, within 14 days of the purchase.
• If Apple refuses a refund you believe you are owed as a consumer, write to support@eliostudy.com and we will help, including by ending the subscription on our side so that you are not charged again.

7.2 Bought on the web

• Cancel anytime from the Account screen. Your plan stays active until the end of the period you have paid for, and is not renewed.
• Full refund within 14 days. If you ask within 14 days of a payment [LAWYER / OWNER: of the first payment for a plan only, or of every payment, including renewals?], we refund that payment in full, without asking why, to the payment method you used, within 14 days of your request. The plan ends when the refund is made.
• Your legal right of withdrawal. As a consumer you have the right to withdraw from this contract within 14 days of concluding it, without giving any reason (Italian Consumer Code, articles 52 and following). To withdraw, tell us clearly, for example by email to support@eliostudy.com, or use the model form below. Because our 14-day refund above returns the full amount, you do not lose anything by using the service during those 14 days. [LAWYER: confirm this wording satisfies art. 49 and 52-59 of the Consumer Code, including the information to give before the service starts during the withdrawal period. Confirm separately how the same right is presented for an App Store purchase, where Apple is the seller and we are not, and whether the model form below must say so.]

8. AI features

Some features use AI to explain answers, write hints, reply to your questions and mark written answers against the question's mark scheme.

• AI can be wrong. An explanation, hint or mark may contain mistakes. Use Elio alongside your teachers and your course materials, not instead of them.
• A mark given by AI becomes part of your study record. If the AI cannot mark an answer, you mark it yourself. [PRODUCT: describe how a student can dispute a mark, if they can.]
• Your plan, the order of your questions and your grade estimates are calculated by Elio's own software, not by AI.
• The AI features are used only once you agree to them, and you can turn them off again in your Account. Without them, everything else in Elio works; see section 3 of the privacy policy.

9. Using Elio fairly

You agree not to:

• share your account, resell access, or let others use it;
• copy, scrape or extract Elio's questions, lessons or other content in bulk;
• try to break, overload, reverse engineer or get around the security of the service;
• use Elio to produce work that you then submit for assessment as your own, including internal assessments, the extended essay and the TOK essay. Follow your school's and the IB's rules on academic integrity;
• use conversations with Elio to create harmful, unlawful or abusive content.

10. Content and ownership

• Elio's questions, lessons, explanations, software, design and brand belong to us or to those who licensed them to us. Your plan gives you a personal, non-transferable right to use them for your own study while your account is active.
• What you write (answers and messages) stays yours. You allow us to store and process it to provide Elio to you, as described in the privacy policy.

11. Changes to the service

We improve Elio continuously and may change features. We will not remove a feature your plan relies on during a period you have paid for without offering you a proportional refund, which for a purchase made through the App Store means asking Apple to make it. We may pause the service briefly for maintenance.

12. Our responsibility

• Nothing in these terms limits your rights as a consumer under the law, including the legal guarantee that digital services conform to the contract (Italian Consumer Code, articles 135-octies and following).
• We are not responsible for exam or assessment results, or for decisions made by schools, universities or the IB.
• We do not exclude liability for fraud, wilful misconduct or gross negligence, or for death or personal injury caused by negligence (Italian Civil Code, art. 1229).
• [LAWYER: set any further limitation of liability that is valid against consumers under Italian law, or leave it out.]

13. Suspending or ending your account

• You can delete your account at any time from the Account screen. Deleting it erases your data permanently, as the privacy policy describes, and ends any plan we bill. A subscription bought through the App Store is cancelled in your Apple Account, not here: deleting your Elio account does not stop Apple charging you, so cancel there first.
• We may suspend or close an account that seriously breaches these terms, after warning you where that is reasonable. If we close a paid account without a breach on your part, we refund the unused part of the period.

14. Complaints and disputes

• Write to support@eliostudy.com first; we answer within [14] days.
• These terms are governed by Italian law. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of that country (Rome I Regulation, art. 6).
• Disputes with consumers are heard by the courts of the place where the consumer lives (Italian Consumer Code, art. 66-bis).
• [LAWYER: the EU Online Dispute Resolution platform closed on 20 July 2025; confirm no ODR link is required, and whether to name an ADR body.]

15. Changes to these terms

If we change these terms in a way that matters, we will tell you by email or in the app at least [30] days before the change applies. If you do not accept the change, you can cancel before it applies and receive a refund of the unused part of any yearly period.

[LAWYER: an Italian-language version is required if Elio is offered to consumers in Italy (Consumer Code, art. 9). State which version prevails.]
